Acceptance of Terms & Conditions

The following are the rules and “Terms” that govern your use of this site and the services offered to you on this site. By using this site you agree to be bound by and to follow these Terms and all applicable laws and regulations governing this site. If you do not agree to these Terms, please do not use this site. We reserve the right to change these Terms at any time, effective immediately upon posting on this site. National Tuxedo Rentals may change, suspend or discontinue all or any aspect of the services (the “Services”) offered to you on this site, including the availability of any feature, database, or Content (collectively, “Content”), without prior notice or liability. By using this site following any changes you agree to be bound by the Terms as changed.

Tuxedo Rental Agreement:

This Rental Agreement sets forth all the terms and conditions of your rental of products from NationalTuxedoRentals.com through our website and or direct ordering by telephone or electronic mail.

PAYMENT

Payment for all rentals is due in full upon placing an order. The fee for rented merchandise shall include: the rental fees, applicable taxes, damage waiver, shipping and handling and any other fees described in the order detailed on the checkout page. Placing an order means that you understand and authorize National Tuxedo Rentals to immediately charge your credit card for the total fees associated with your order.  By submitting you payment card, or any associated payment method, you authorize National Tuxedo Rentals to charge payment for any fees incurred as described in these rental terms.  If the event creator chooses the option to pay for all the tuxedo rentals, he or she will be responsible for making all payments and any fees incurred if the tuxedo is not returned, or returned late.

RECEIPT OF ORDER

It is your responsibility to immediately inspect and try on all of the items ordered upon delivery.  If any garment does not fit or if you find any issues with your rental items, you must notify us within 2 calendar days (48 hours) of the package receipt (initial delivery).  You agree that in order to notify us that you require a replacement item, you must use the online replacement form which can be found under the “My Account” tab at www.NationalTuxedoRentals.com. 

EXCHANGES / REPLACEMENT ITEMS

If you have an issue with sizing, you are entitled to one free replacement order as long as it is requested within 48 hours of initial delivery. All style changes are subject to a $15 processing fee. You may still request any replacement items beyond the 48 hours mark, however, you will be responsible for any express shipping & processing fees required to deliver your new item/s before your event date.

SIZING ADJUSTMENTS

You grant National Tuxedo Rentals permission to edit the sizes of rented attire as deemed necessary by our outfit specialists. Our outfit specialists utilize technology and expertise to make informed adjustments to sizes, ensuring a better fit for your rented attire. While we make every effort to ensure a perfect fit, variations in fit may occur based on individual body types and preferences.In the event that rented attire does not fit as expected, National Tuxedo Rentals offers free sizing replacements to ensure customer satisfaction. Please refer to our Exchanges/ Replacements Policy for further details on the process.

CANCELLING, CHANGING, OR POSTPONING YOUR ORDER

Rental orders can be cancelled before shipment for a full refund, minus a $35 cancellation fee. Once the items are shipped, you understand and agree, that nationaltuxedorentals.com will not provide a refund or credit for any reason, including but not limited to event cancellations, inclimate weather, and any other reason outside of our control. This is a firm policy designed to prevent fraud and abuse of our system. This allows us to keep our prices low for all customers, and ensure the highest integrity of our service.

If you need to make any changes to your rental order, please contact us before the shipment of your items. If your items have shipped, you will need to wait until the items arrive to fill out the rental exchange form.

If your event is postponed, you must purchase a rental extension to cover the additional time that your items will remain in your possession.

DELIVERY & RETURN

Delivery: Rental order placed at least 3 weeks prior to the event date will ship to arrive 10-14 days before the event date via via FedEx Ground Delivery, United Parcel Service (UPS) or other national recognized shipping service. Orders placed within 3 weeks prior to the event date will ship to arrive as soon as possible, via the shipping method selected at checkout. Once the package has been handed over to the shipping carrier, the delivery process is beyond our control, and we cannot be held responsible for any delays caused by the shipping carrier. It is the customer’s responsibility to monitor the shipment status with the tracking information provided. If a shipment appears to be delayed, please notify us before your event date for accommodations to be made.We ship only to a valid residence, office, or nationally recognized hotel address within the continental United States. We do not ship to PO Boxes or outside of the United States.

Return: All rental items are due back in transit within three (3) days after the event/use date stated on your order. Any items unreturned by this date are subject to all applicable late fees and replacements costs as stated in this Tuxedo Rental Agreement. To return, we provide a pre-paid return shipping label with your order [if you lost your Return Label, please contact us immediately for a new one. It is your responsibility to have the garment(s) in transit back to our warehouse in the fore mentioned time frame]. Place all rental items that you received in the original shipping box, place the supplied return label over the original shipping label, and deliver to an authorized Fedex or UPS shipping site (whichever your package arrived) or arrange for a home pick-up within the time frame.  You do not need to clean your items prior to returning them. We are not responsible for personal property accidentally or otherwise returned with the rental order.

If your tuxedo rental is being returned late, you are responsible for shipping your rental back to: National Tuxedo Rentals 100 Ward Ave Trenton, NJ 08609 using any shipping service you choose.

CUSTOMER ALTERATIONS

You agree that you understand that you are authorized to make non-permanent alterations to the Jacket/Pant length at your convenience. If you incur fees associated with non-permanent alterations, we will reimburse you up to $15.00 if (1) the service is provided before your event date, (2) you can provide a copy of a valid receipt, and (3) you send us a copy of the receipt before your rental items are due to be shipped back to us pursuant to our return policy. 

FEES

In addition to the cost of your rental, the following fees may also apply as detailed in this Rental Agreement. In the event you incur any additional fees, your payment card or account will automatically be charged.

LATE FEES & REPLACEMENT COSTS

Any rental items that are not in transit within 3 calendar days after the event date will be charged at the rate of $15.00 per day, per-person/tuxedo. Any items damaged beyond repair or that are not returned to National Tuxedo Rentals within 21 days of your event date (without making arrangements to return), will result in replacement/processing costs as listed below which shall be billed on the payment card, or associated payment method that was given at time of order. You will not receive any refund or other payment after returning your items.

Replacement and Processing Costs for Items

FREE GROOM TUXEDO OFFER TERMS

To be eligible for the Free Tuxedo Offer, you must be a groom with an event profile, created/registered on NationalTuxedoRentals.com, containing at least four paying members (renting complete tuxedos or suits). At least 4 members, who have been add to the event profile in addition to the groom, must checkout and pay in full for a complete tuxedo or suit rental package on NationalTuxedoRentals.com at least 10 days before the event date. The GROOMRENTSFREE discount code may only be used by one (1) individual within the event profile, with their role selected as “groom” in the event profile. The GROOMRENTSFREE discount code will be equal to the amount of the majority tuxedo package of the group. If the groom/individual using the discount code, chooses a higher priced tuxedo compared to the majority of the group members, they will be responsible for paying any difference in price that the discount code does not cover. The discount code will cover a standard tuxedo or suit rental package (including a coat, pant, shirt, waistwear option, neckwear option, studs & cufflinks). Additional upgrades, including but not limited to, suspenders, shoes, pocket square, and slim fit/skinny fit upgrades, are not included in the free tuxedo offer. A Damage Waiver is automatically applied to all rental orders at checkout and will not be covered by the free tuxedo discount code. The free groom discount code may cannot be used on “RUSH” orders (orders placed within 3 weeks of the event date).

Abuse of Free Tuxedo Code: If the event profile does not meet the above criteria and/or the required four (4) members within the group profile have not rented and paid for a complete tuxedo or suit package by 10 days prior to the event date, the card used in conjunction with the “GROOMRENTSFREE” discount code will be charged for the value of the code used. If more than one individual within the group profile uses the discount code at checkout, the card will be charged for the value of the code used. The free groom code may not be used on “rush” orders (orders placed within 3 weeks of the event date).

CASH-BACK INCENTIVE TERMS & CONDITIONS

This offer is available to only customers who have rented or purchased a tuxedo or suit from National Tuxedo Rentals. To qualify for the $10 cash back, customers must do one of the following: Share a photo of themselves wearing our tuxedo/suit on social media (Facebook or Instagram) and tag our official account (@NationalTuxedoRentals). After posting, the customer must fill out the online form to be considered for a refund. Alternatively, customers can send the photo directly to us via our online form. Photos must clearly show the customer wearing the tuxedo or suit. All submitted photos will be reviewed by our team. We reserve the right to reject photos that do not meet the guidelines (e.g., inappropriate content or photos that do not clearly feature our product). Once the photo is approved, the $10 cash back will be processed within 1-2 business days to the original form of payment on the order specified on the submission form. Each customer is eligible for only one $10 cash back per order, regardless of the number of photos submitted or shared. By participating in this promotion, customers agree that National Tuxedo Rentals may use the submitted photos for marketing purposes (including but not limited to social media, website content, and promotional materials) without additional compensation. This offer cannot be combined with any other promotions or discounts. National Tuxedo Rentals reserves the right to modify or terminate this promotion at any time without prior notice. By submitting our online form, you agree to abide by these terms and conditions.

Return Policy For Purchase (Buy) Items

PURCHASE RETURNS

If you have purchased items, you may be eligible for a refund if the unused items are returned within 30 days of delivery and before your Event Date (stated at checkout). You may not be eligible for a refund if your original “Event Date” on your order has passed. To return your items and ensure that your refund is processed, you must contact us to request a Return Authorization before shipping your item/s back. The shipment must be postmarked with a date that is 30 days or less from the initial delivery date and before your Event Date. Your refund will be processed once the return arrives at our return department.

If you would like to exchange your item for a different style/size, we recommend ordering a new item once your return is initiated and/or processed.

Terms and Conditions of Website Use.  Except as expressly provided in these Terms and Conditions of Website Use neither any part of this website nor any content located herein may be reproduced in any form, copied, republished, posted, publicly displayed, encoded, reproduced, translated, transmitted or distributed in any form to any computer, server, website, or other electronic or other device for purposes of publication or dissemination without written consent executed by the legal department of Nationaltuxedorentals.com.  You agree you may not pursue any course of action with the purpose of gaining unauthorized access to the website in any form or by any method whatsoever. You agree not to interfere with the function of the website, or any systems or networks connected to the website.  You agree that you will not disguise any communication or access the site using a fictitious identity.  You agree that Nationaltuxedorentals.com has the right at any time, and without notification terminate your access to the website or otherwise interrupt service to the website as necessary or convenient.

Section 3

Privacy Policy.  You agree and understand that when you utilize our website we automatically gather certain information which may be stored including Internet protocol (IP) addresses, Internet service provider (ISP), referring/exiting pages, operating system, date/time stamp, browser type, clickstream data.  You also agree and understand that Cookies may be stored on your computer from the use of our site.  You can restrict Cookies; however, this may interfere with your access to our site.  This data is used to improve our service and improve your experience. 

Internet Security/Credit Card Security.  The security policy we follow to protect the personal information submitted to us, both during transmission and once we receive it, is that of generally accepted industry standards.  You agree that this is an acceptable standard and that you understand that internet transmissions are never completely secure or private.  You agree and understand that any message or information you send to the website may be read or intercepted by other parties and that such information may include encrypted information such as credit card data.

Minors.  Nationaltuxedorentals.com will not knowingly collect personally identifiable information from any visitor under the age of 13 without prior verifiable parental consent. You agree that if you become aware that your dependent child or child you are responsible for has registered without your consent, you will notify us immediately so that we can delete the registration from our files.

Limited Liability.  The full extent of Nationaltuxedorentals.com liability or warranty to you is governed by this website Customer Terms of Use Agreement.

All software used on this site is the property of National Tuxedo Rentals, or its software suppliers, and protected by U.S. and international copyright laws. The Content and software on this site may be used solely as provided in these Terms. Any other use of the Content on this site is strictly prohibited.

Trademarks

National Tuxedo Rentals, and other National Tuxedo Rentals graphics, logos and service names are trademarks of National Tuxedo Rentals. All other marks contained on this site are the sole property of the parties indicated.

Procedure for Making Claims of Copyright Infringement

National Tuxedo Rentals and its affiliates respect the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please e-mail or write us with your complaint.

Please include the following information:

• Identification of the copyrighted work claimed to have been infringed;
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material;

National Tuxedo Rentals owns this site. Within this site and these Terms, when we say “National Tuxedo” “we,” “us,” or “our,” we mean National Tuxedo Rentals. No material from this site may be sold, copied, reproduced, republished, uploaded, displayed, posted, transmitted, distributed, modified, publicly performed, used in any derivative works based thereon or otherwise used for any public or commercial purpose without the prior written consent of National Tuxedo or, where applicable, our licensors. National Tuxedo grants you a limited license to access and make personal use of this site and not download (other than page caching) or modify it without express written consent of National Tuxedo. Changing the Content or using the Content on this site in any other way is a violation of our rights. The use of the Content on this site, without our written permission, on any other site or computer network is prohibited.

Improper behavior is prohibited

Within this site, you are not allowed to distribute (by whatever means) materials that are libelous, defamatory, obscene, pornographic, threatening, invasive of privacy or publicity rights, abusive, illegal, or that we otherwise deem distasteful or objectionable.

Use of comments

All submissions submitted or offered to National Tuxedo on or by this Site (collectively, “Comments”) shall be and remain the property of National Tuxedo and the sponsors of relevant promotions. Such submissions or offer of any Comments shall constitute an assignment to National Tuxedo or the sponsors, as appropriate, of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments. Thus, National Tuxedo or the Sponsors will own exclusively all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise, of any Comments. Disputes

You agree that any action at law or in equity arising out of or relating to these Terms or arising out of this site shall be resolved through biding arbitration using the then current rules of the American Arbitration Association, in Austin, Texas and the resulting decisions may be entered in any court with proper jurisdiction. This means that if you have a grievance with us, you cannot take us to court. You can address such grievances through arbitration only and you are hereby consenting to do it in Austin, Texas, using Texas’ laws (without regard to Texas’ conflicts of laws). Limitation of Liability

Under no circumstances, including, but not limited to, negligence, shall National Tuxedo be liable for any special or consequential damages that result from the use of, or the inability to use, the materials in this site, even if National Tuxedo or a National Tuxedo authorized representative has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event shall National Tuxedo’s total liability to you for all damages, losses and causes of action (whether in contract, tort (including, but not limited to, negligence), or otherwise) exceed the amount paid by you, if any, for accessing this site.
